On January 20, 2024, Supreme Decree No. 001-2024-SA was approved, which approves the Regulation of Law No. 31561, Law for the Prevention of Cancer in Women and the Strengthening of Specialized Oncological Care.
This regulation grants one day a year of paid leave for female workers in the public and private sector, including the Peruvian National Police and the Armed Forces, who go for early detection of breast and cervical cancer.
It mainly aims to promote the welfare of female workers through the early detection of diseases such as breast and cervical cancer without affecting their labor situation.
Leave Application Requirements
In order to access this leave, the female worker must file her application for paid leave for early detection of breast and/or cervical cancer exams with her superior authority three working days in advance, attaching the appointment schedule.
Subsequently, you must demonstrate the care through a certificate within three working days of the medical appointment.
It should be noted that, according to paragraph 4.3 of the Regulations of Law No. 4.3, the paid leave granted to the employee is covered by the employer, who cannot require ESSALUD to finance it.
This Law applies in the national territory and came into force on January 21, 2024.
