This behavior, according to the agency’s analysis, misled consumers regarding the business origin of the products and services offered. Consequently, INDECOPI decided to impose a sanction that included a reprimand, the immediate and definitive cessation of the questioned practices, as well as the registration of Business Solutions in the Register of Unfair Competition Offenders. In addition, it ordered the payment of the costs and expenses of the proceeding in favor of the plaintiff, setting a clear precedent for protecting fair competition in the Peruvian market.

INDECOPI pointed out that, although imitation of elements in an Arm’s Length market is allowed, it must avoid confusing the business origin.
