APEC 2024: Non-working Days and Key Recommendations for Businesses

Introduction

The Peruvian Government has declared November 14, 15, and 16, 2024, through Supreme Decree No. 110-2024-PCM, non-working days in Metropolitan Lima and Callao for the APEC Leaders’ Summit. Since these days are not holidays, workers will not receive additional payments when they fulfill their tax obligations. This measure intends to facilitate the logistics of an international event and reduce the impact on the city’s mobility. Likewise, Supreme Decree No. 123-2024-PCM has established the lessons of November 11, 12, and 13 to be held virtually due to the Asia-Pacific Economic Cooperation (APEC) Leaders’ Week, which will be held from November 9 to 16. 

Recovery of Hours in the Public and Private Sectors

The recovery of hours will be as follows: 

  • Public: Non-worked hours will be compensated in the following 15 days. Conversely, each public entity may adjust the period according to its needs. 
  • Private: Companies and employees must agree on the hour recovery. In case of disagreement, the employer will decide the compensation form. This measure requires prior planning and communication to avoid conflicts. 

Continuity of Essential Services

The aforementioned Supreme Resolution ensures the operation of essential services in both sectors, such as health, security, telecommunications, and cleaning. Likewise, activities such as food vending and public transportation will continue to operate, thus guaranteeing the continuity of essential services and mitigating the effects of non-working days. 

Recommendations for Companies

  • Planning for recovering hours: Formalizing agreements for compensating hours in advance will prevent conflicts. 
  • Communication to essential services workers: Companies should clearly inform those who work on non-working days. 
  • Compliance with tax obligations: Since the days are tax days, the established deadlines must be met. 
  • Implementation of telecommuting: Where possible, telecommuting could reduce travel. 
  • Advance vacation: Consider advancing scheduled vacation for those employees whose functions are not essential during non-work days, reducing the need for compensatory hours and making scheduling easier. 
  • Vacation fractionation: It allows employees to take vacation in fractions of days or weeks, making it easier to organize staff without affecting productivity. 
  • Flexible scheduling: It implements flexible schedules on days close to the summit, allowing employees to adjust their workday to compensate for hours more comfortably.

Peru is one of the 21 countries that make up APEC, a promoter platform of economic cooperation in health, science, technology, and SME integration. With 62% of production and 48% of global trade, APEC fosters sustainable economic growth and promotes strengthening institutions and sectors crucial to development.
