APEC 2024: Non-working days and key recommendations for businesses

Introduction

The Peruvian Government, through Supreme Decree No. 110-2024-PCM, has declared November 14, 15 and 16, 2024 as non-working days in Metropolitan Lima and Callao on the occasion of the APEC Leaders’ Summit. Since they are not holidays, no additional payment will be generated for workers who work on those dates, and they will continue to be working days for the fulfillment of tax obligations. This measure seeks to facilitate the logistics of an event of international relevance and reduce the impact on the city’s mobility. Likewise, through Supreme Decree No. 123-2024-PCM, it has been established that on November 11, 12 and 13, classes will be held virtually, in the context of the Asia-Pacific Economic Cooperation (APEC) Leaders’ Week, which will be held from November 9 to 16.

Recovery of hours in the public and private sectors

The recovery of hours is established in a differentiated manner:

  • Public sector: hours not worked will be compensated in the following 15 days. However, each public entity may adjust the period according to its needs.
  • Private sector: Companies and employees must agree on the recovery of hours. In case of disagreement, the employer will decide the form of compensation. This measure requires prior planning and communication to avoid conflicts.

Continuity of essential services

The aforementioned Supreme Resolution ensures the operation of essential services in both sectors, such as health, security, telecommunications and cleaning. Likewise, activities such as food vending and public transportation will continue to operate, thus guaranteeing the continuity of basic services and mitigating the impact of non-working days.

Recommendations for companies

  • Planning for the recuperation of hours: Formalizing agreements for the compensation of hours in advance will help prevent conflicts.
  • Communication to essential services workers: Companies should clearly inform those who will be working on non-working days.
  • Compliance with tax obligations: Since the days are tax days, the established deadlines must be met.
  • Implementation of telecommuting: Where possible, telecommuting may be an option to reduce travel.
  • Advance vacation: Consider advancing scheduled vacation for those employees whose functions are not essential during non-work days. This will help reduce the need for compensatory hours and make scheduling easier.
  • Vacation Fractionation: Allows employees to take vacation in fractions of days or weeks, making it easier to organize staff without affecting productivity.
  • Flexible scheduling: Implements flexible schedules on days close to the summit, allowing employees to adjust their workday to compensate hours more comfortably.
