Tax Exemptions in Peru: Which Benefits Might the Peruvian Government Review?

Tax exemptions and other tax benefits have taken on particular importance on Peru’s economic agenda. The government has stated that it will review those benefits that do not adequately meet the purposes for which they were created.   

Tax exemptions represent a waiver of tax payments for certain sectors, activities, or taxpayers. However, they also represent a cost to public finances. 

Why are they currently under review? 

The debate arises in a context where the Government is seeking to strengthen its tax revenue. 

This discussion does not necessarily mean that all exemptions will be eliminated. In fact, the real challenge consists of determining which ones generate concrete results or simply reduce tax revenue without producing sufficient effects. 

What should companies evaluate? 

Companies that currently utilize a tax benefit should identify: 

  1. The regulation establishing the benefit.
  2. The eligibility requirements.
  3. The period of validity.
  4. The associated formal obligations.
  5. The documentation required to demonstrate compliance.

The importance of this is particularly significant because a tax benefit does not automatically mean the company can apply it. 

What could happen? 

A potential review could result in changes to rates, deadlines, requirements, or eligibility conditions. 

Therefore, companies that rely significantly on a special tax regime should incorporate alternative tax scenarios into their financial planning.
